inherent qualities
The client is aware that color dyes in printed photographic materials may fade or discolor over time due to the inherent qualities of the dyes and chemicals. The client releases Free Bird Photography/Free Bird Photography from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.
standard price list
The charges in this contract are based on Free Bird Photography’s standard price list. This price list is adjusted periodically and any future orders or additions to this contract shall be charged at the prices in effect at the time when the order is placed or change requested. Album and print orders require full payment in advance.
release of digital negatives
If an agreement is reached between the client and photographer, Free Bird Photography will release the high-resolution files (digital negatives) to the client upon completion of downloading, backing up, raw processing, and hand editing images. Typical turn around time for delivery of images is 4-6 weeks from wedding date, but can vary depending on how busy the studio becomes. These files will be deliverd via online download. Delivery by USB is available for an additional $30.
By releasing the digital negatives Free Bird Photography authorizes the client to use the images contained in the download for their own personal use. The digital negatives will be sized to 8”x12” and high resolution but will not be of the same quality as the custom prints edited for the purpose of custom enlargements and album prints. Free Bird Photography is not responsible for the quality of enlargements from these files that have been taken to a non-professional and/or consumer photo lab. The images may not be sold or published without the written consent of the photographer. Free Bird Photography will retain the copyright of the images as well as the exclusive rights detailed in section “copyright and reproductions.” Upon releasing the digital negatives to the client Free Bird Photography is released of all liability for archiving all of the files. Requests for additional and/or replacement copies of these files will be billed at $200 per set. Free Bird Photography guarantees backup of files for 18 months of event date.
proofs and custom prints
Proof images are individually edited for color correction, contrast adjustments, tonal adjustments, and conversion to black and white (if applicable). The proof images are used for online proofing, digital negatives, USBs, and proof books. The custom print includes a variety of techniques to create the photographer’s interpretation perfect print. Steps taken may include and are not limited to: realistic retouching, blemish removal, selective toning of colors, tonal adjustments and color enhancements, removal of distracting elements, etc. Custom prints are included in wedding albums, custom books, and custom prints and enlargements.
albums and print products
The client is responsible for submitting a list of at least 40 images to be included in first design iteration of wedding album 30 days after gallery delivery date. Album design process and approval shall not exceed 4 months from wedding date. Once album is approved, it will be hand-delivered or mailed within 5 weeks from approval date. Print products will be hand-delivered or mailed within 4 weeks of purchase, unless notified otherwise by Free Bird Photography.
officiant and venue restrictions
The photographer may be necessarily limited by the guidelines or rules of the ceremony official, ceremony venue, or reception venue. Client understands and agrees that Free Bird Photography will abide by such guidelines or rules and that they are outside the control of Free Bird Photography. The client agrees to hold Free Bird Photography harmless for the impact such guidelines or rules may have on the resulting photographs.
requested photos
While Free Bird Photography will make every reasonable effort to take specifically requested photos,the client understands that a wedding is an uncontrolled event and that due to the varieties of the weather, available light, time constraints and willingness or availability of subjects, Free Bird Photography cannot guarantee that any particular requested photo will be taken.
artistic license
Free Bird Photography shall be granted full artistic license in relation to the poses photographed and the locations used. The photographer will not be held responsible for the lack of coverage caused for the following reasons: the bride, groom or wedding party not being on time, members of the wedding party or family are unavailable when called on for a posed photograph, if the wedding is running late or if restrictions regarding photography at the desired location of the wedding are in force. The client understands that Free Bird Photography does not photograph from a “shot list” throughout the wedding day. Client will furnish Free Bird Photography with a list of any persons, groups, or occurrences specifically desired to be photographed, if any, at least one week before the wedding date so that necessary resources and scheduling may be arranged. The essence of the Free Bird Photography’s photographic approach a combination of unposed, journalistic, editorial and fine art coverage of actions in real time. The client acknowledges that they have been shown a complete set of wedding images and they understand that Free Bird Photography will produce images of like quality and style from their wedding.
event food service
A meal and one slice of cake/dessert is required for Erika Ashauer and any additional team members of Free Bird Photography during an event4 hours or longer. If no meal is provided, it is understood that the photographer will leave the event to purchase a meal.
miscellaneous
This contract incorporates the entire understanding of both parties. Any modifications to this contract must be in writing and signed by both parties. Any adjustments to this contract cannot reduce the total overall dollar value. This contract shall be governed by the laws of the state of Colorado.
ALL TERMS OF THIS AGREEMENT ARE UNDERSTOOD AND AGREED UPON.
